國 際 法 專 題 研 究

Seminar on International Law

時 間：九十六學年第二學期，星期四第 7,8 節 （15:30-17:20）

課程設計與目標：

1.    本課程主要目的在讓同學瞭解國際法議題的內容與影響。經由分析當前國際社會的主要事件與議題，認識國際關係的規範與秩序面，深刻掌握國際法對於國際事務與外交決策的影響。

2.    本課程採取「個案研究」方式上課，由於同學對國際法已有基本認識，排除傳統念文章與報告方式，經由探討目前重要國際事件與議題，分析該事件的國際法與規範層面的內容，深入掌握國際法是如何影響事件發展、國家決策、以及國際組織行為等。

3.      課程以個案研究、事件分析、閱讀、報告、討論方式進行。

課程要求與閱讀：

同學必須在上課前閱讀指定教材、課前研析個案資料、課堂積極參與討論。

同學必須針對每項個案進行資料蒐集與閱讀，每次主要議題內容的準備分為「事件組」、「法律組」、「辯論組」三組進行，事件組負責整理該事件與議題的歷史發展與過程，法律組負責整理該事件與議題的相關國際法內容，辯論組則分正反兩方在課堂上進行辯論。

分數標準：

1. 四份摘要心得報告60%（主要議題之摘要與評論、每份不得少於五頁，每份報告在議題結束後兩週內繳交）（也可選擇撰寫一份學期報告，但須經與老師討論題目與大綱，並在課堂報告，學期結束時繳交）。

2. 模擬法庭辯論報告（20%）

3. 課堂討論和參與（20%）。
